Water Resources Law
The course will begin with an overview survey of the general legal norms governing water allocation. First we will study the Riparian system of allocation. We will conclude that study with an examination of water resource issues facing Georgia and its neighbors. We will then examine western prior appropriation systems. We will also conclude that study with examining the dispute among users of the Colorado river. We will conclude the course by studying the evolution of control of water allocation from the courts to administrative agencies; public rights in water, including the right to use surface water for recreation and rights under the public trust doctrine; and the impact of environmental statutes on water allocation.
